1.1 Overview
Wizetrak Inc. respects your privacy. This Privacy Policy explains what personal information we collect through the Platform (wizetrak.com and our web application), why we collect it, how we use and share it, and the choices and rights available to you. This Policy applies to all users of the Platform, including production companies, studios, creator businesses, vendors, and talent across any industry that manages contracts tied to a connected source of revenue.
Note on Scope: Wizetrak is not currently designed or authorized for use in collecting or processing protected health information ("PHI") or other regulated health data (see Section 1.2 of the Terms), so this Policy does not address HIPAA-specific processing.
1.2 Information We Collect
a. Information you provide directly
- Account and profile data: name, company/production name, job title, email, phone number, billing address, username, and password.
- Billing and payment data: billing contact, payment method details (processed by our third-party payment processor — see 2.5), and transaction history.
- Business and financial content: contracts, deal memos, NDAs, vendor and talent information, budgets, invoices, tax forms (W-9, W-8BEN, I-9), and payment authorization records.
- Signature and identity data: electronic signatures, IP address at signing, signature timestamps, and related audit-trail metadata.
- Communications: support tickets, emails, and any feedback you provide.
b. Information collected automatically
- Device and log data (IP address, browser type, operating system, device identifiers).
- Usage data (pages viewed, features used, session duration, click paths).
- Cookies and similar technologies (see Section 2.8).
c. Information from third parties
- Identity verification providers, where used for account or e-signature verification.
- Payment processors, for transaction confirmation and fraud prevention.
- Integrated third-party services you choose to connect to your account (e.g., accounting, calendar, or CRM platforms), subject to your permissions.
1.3 How We Use Information
We use the information above to:
- provide, operate, secure, and maintain the Platform (including routing contracts, invoices, and e-signatures);
- process payments and manage billing, invoicing, and subscriptions;
- verify identity and prevent fraud, abuse, and unauthorized access;
- communicate with you about your account, transactional notices, and support requests;
- improve and develop the Platform, including through aggregated, de-identified analytics;
- comply with legal, tax, and regulatory obligations (including recordkeeping for signed documents); and
- with your consent, send product updates or marketing communications, which you may opt out of at any time.
We do not sell personal information, as "sale" is defined under the California Consumer Privacy Act (CCPA/CPRA) or similar state laws.
1.4 Legal Bases (where applicable)
Where required (e.g., for users in the EEA, UK, or similar jurisdictions), we process personal information based on: performance of a contract with you, our legitimate business interests (e.g., security, product improvement), compliance with legal obligations, and consent (e.g., for marketing).
1.5 How We Share Information
We share information only as necessary and described below. We do not sell your personal information.
- Service Providers: cloud hosting, payment processing, e-signature infrastructure, identity verification, customer support tools, and analytics providers, bound by confidentiality and data-protection obligations.
- Within Your Organization: with other authorized users in your Organization's account, per the roles and permissions your Organization configures.
- Counterparties in Your Workflow: e.g., a vendor, client, or talent counterparty named in a contract or invoice — only as necessary to complete the workflow you initiate.
- Legal and Safety: to comply with law, respond to lawful requests from public authorities, enforce our Terms, or protect the rights, property, or safety of Wizetrak, our users, or the public.
- Business Transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
- With Your Consent: for any other purpose disclosed to you at the time of collection.
1.6 Data Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls, audit logging, and SHA-256 hashing for signed-document integrity. No system is completely secure, and we cannot guarantee absolute security; we will notify affected users and, where required, regulators without undue delay in the event of a data breach involving personal information, consistent with applicable law.
1.7 Data Retention
We retain personal information for as long as necessary to provide the Platform, comply with legal and tax obligations, and resolve disputes. As a general baseline: signed documents and related audit-trail data are retained for a minimum of seven (7) years consistent with e-signature recordkeeping practice, and billing records are retained per applicable tax law. Upon account closure, we retain data for 30–90 days to permit export, after which it is deleted or de-identified except where longer retention is legally required.
1.8 Cookies and Tracking Technologies
We use cookies and similar technologies to operate the Platform, remember preferences, and understand usage (e.g., via analytics tools). You can control cookies through your browser settings; disabling cookies may limit some Platform functionality. We do not currently use third-party advertising cookies on the application itself.
1.9 Your Privacy Rights
Depending on your location, you may have the right to: access, correct, or delete your personal information; opt out of certain processing or marketing communications; request a copy of your data in a portable format; and, where applicable (e.g., California, other U.S. states, EEA/UK), lodge a complaint with a supervisory authority. To exercise these rights, contact us at [email protected]. We will verify your identity before fulfilling a request and may decline requests where an exemption applies (e.g., legal retention obligations or active disputes).
California residents: we do not sell or share personal information for cross-context behavioral advertising. You have the right to non-discrimination for exercising your privacy rights.
1.10 Children's Privacy
The Platform is intended for business and professional use and is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child's information has been submitted to the Platform, contact us at [email protected] for deletion.
1.11 International Data Transfers
Wizetrak primarily stores and processes data in the United States. If you access the Platform from outside the U.S., you understand your information will be transferred to and processed in the U.S., which may have different data protection laws than your country. We take steps to ensure adequate protection for such transfers consistent with applicable law.
1.12 Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated "Last Updated" date, and where required, we will provide additional notice (e.g., email or in-app banner).
